PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS WEBSITE OR ENGAGING SERVICES FROM HOLISTIC MINDS PSYCHIATRY. By accessing this website, submitting a contact or screening form, scheduling an appointment, or receiving services from Holistic Minds Psychiatry ("Practice," "we," "us," or "our"), you ("Client," "Patient," or "you") acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety. If you do not agree, do not use this website or engage our services.
1. Nature of Services — Telehealth Primary; In-Person Upon Request
Holistic Minds Psychiatry provides outpatient psychiatric evaluation, medication management, individual therapy, and related mental health services exclusively to adults aged 18 and older residing in New York State. Our primary mode of service delivery is telehealth (synchronous audio-video). In-person appointments at Suite 4004 A, 2116 Merrick Ave, Merrick, NY 11566 are offered on a limited, availability-based basis and only upon the Client's specific request. In-person availability is not guaranteed and is subject to change at any time without notice. The Practice reserves the right to require telehealth as the sole modality for any individual Client at its sole clinical discretion.
2. No Guarantee of Outcomes — Limitation of Liability
HOLISTIC MINDS PSYCHIATRY MAKES NO REPRESENTATIONS, WARRANTIES, OR GUARANTEES, EXPRESS OR IMPLIED, REGARDING THE OUTCOME, EFFECTIVENESS, OR RESULTS OF ANY PSYCHIATRIC EVALUATION, DIAGNOSIS, TREATMENT, MEDICATION, THERAPY, COACHING, OR ANY OTHER SERVICE PROVIDED. Mental health treatment is inherently individualized and uncertain. Results vary significantly among individuals. Nothing on this website or communicated by our staff constitutes a promise, guarantee, or warranty of any clinical outcome, symptom improvement, recovery, or fitness for any particular purpose. TO THE FULLEST EXTENT PERMITTED BY NEW YORK LAW, THE PRACTICE'S TOTAL LIABILITY TO ANY CLIENT FOR ANY CLAIM ARISING OUT OF OR RELATED TO SERVICES SHALL NOT EXCEED THE TOTAL FEES PAID BY THAT CLIENT IN THE THREE (3) MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL THE PRACTICE BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES.
3. Client Responsibilities
You acknowledge and agree that your mental health and overall wellbeing are ultimately your own responsibility. As a Client, you are responsible for: (a) providing accurate, complete, and current information about your health history, current symptoms, medications, and any other information relevant to your care; (b) actively participating in your treatment, including attending scheduled appointments, following agreed-upon treatment plans, and communicating openly with your provider; (c) notifying the Practice promptly of any changes in your condition, medications, or circumstances that may affect your care; (d) maintaining a safe, private, and distraction-free environment during telehealth sessions; (e) ensuring you have a reliable internet connection and compatible device for telehealth appointments; (f) complying with all applicable laws and regulations in connection with your use of our services; and (g) seeking emergency services (call 911 or go to the nearest emergency room) immediately if you are experiencing a psychiatric emergency, suicidal ideation with intent or plan, or any other life-threatening situation. The Practice is not an emergency service provider.
4. Right to Discontinue Services — Client
You have the right to discontinue services with Holistic Minds Psychiatry at any time, for any reason, without penalty, subject to the following: (a) you remain responsible for payment of all fees for services rendered prior to discontinuation; (b) you are encouraged to notify the Practice in advance so that appropriate transition planning and referrals can be arranged; (c) abrupt discontinuation of certain psychiatric medications can be medically dangerous — you are strongly advised to consult with your provider before stopping any prescribed medication; and (d) the Practice will provide a summary of care and referrals upon request to support continuity of care.
5. Right to Discontinue, Transfer, or Discharge — Practice
Holistic Minds Psychiatry reserves the right, at its sole clinical and administrative discretion, to discontinue, suspend, transfer, or discharge a Client from services at any time, with or without cause, including but not limited to the following circumstances: (a) the Client's clinical needs exceed the level of care that can be safely and appropriately provided via telehealth or outpatient services (e.g., the Client requires inpatient hospitalization, intensive outpatient programming, or a higher level of psychiatric care); (b) the Client is non-compliant with the treatment plan, repeatedly misses appointments, or fails to engage meaningfully in care; (c) the Client engages in threatening, abusive, harassing, or disrespectful behavior toward Practice staff or providers; (d) the Client provides false or materially misleading information; (e) the Client fails to pay for services rendered; (f) the Practice determines that a therapeutic relationship cannot be established or maintained; (g) the Practice ceases operations, changes its service area, or modifies its scope of services; or (h) continuation of services would be clinically contraindicated or ethically inappropriate. Upon discharge, the Practice will make reasonable efforts to provide the Client with a referral to an appropriate level of care and a summary of treatment, in accordance with applicable New York State professional standards and the New York Education Law.
6. Level of Care and Telehealth Appropriateness
Telehealth psychiatric services are appropriate for many individuals but are not suitable for all clinical presentations. The Practice conducts an initial clinical assessment to determine whether telehealth is appropriate for each Client. The Practice reserves the right to determine, at any time during the course of treatment, that a Client's clinical needs require a higher level of care than telehealth outpatient psychiatry can provide. In such cases, the Practice will communicate this determination to the Client and provide referrals to appropriate resources. The Practice shall not be liable for any harm arising from a Client's refusal to accept a referral to a higher level of care or the Client's decision to continue seeking only telehealth services when a higher level of care has been clinically recommended.
7. Coaching Services — Distinct from Clinical Care
Certain services offered by or affiliated with Holistic Minds Psychiatry, including ADHD and Anxiety Coaching, are offered exclusively as wellness coaching and psychoeducational support for individuals who are already diagnosed and receiving psychiatric medication management. Coaching services: (a) do not constitute the practice of medicine, psychiatry, psychology, or psychotherapy; (b) do not involve diagnosis, prescription, or clinical treatment; (c) are not a substitute for evaluation or treatment by a licensed healthcare provider; and (d) do not create a physician-patient or therapist-client relationship. Clients receiving coaching services acknowledge these distinctions and agree that the Practice bears no clinical liability for outcomes related to coaching services.
8. Emergency Situations — No Crisis Services
Holistic Minds Psychiatry does NOT provide emergency psychiatric services, crisis intervention, or 24/7 on-call coverage. If you are experiencing a psychiatric emergency, are in danger of harming yourself or others, or are in any life-threatening situation, you must: call 911 immediately; go to the nearest hospital emergency room; or call or text 988 (Suicide and Crisis Lifeline). Do not attempt to contact the Practice for emergency situations. The Practice expressly disclaims any liability for harm arising from a Client's failure to seek emergency services when clinically indicated.
9. Appointments, Cancellations, and No-Shows
Clients are required to provide at least 24 hours advance notice to cancel or reschedule an appointment. Late cancellations (less than 24 hours notice) and no-shows may be subject to a cancellation fee as set forth in the Practice's financial policies provided at intake. Repeated late cancellations or no-shows may result in discharge from the Practice. The Practice reserves the right to modify its cancellation policy at any time upon reasonable notice.
10. Telehealth Consent and Technology Requirements
By scheduling and attending a telehealth appointment, you consent to the delivery of psychiatric services via audio-video technology. You acknowledge that: (a) telehealth has inherent technological limitations and may be interrupted by connectivity issues; (b) you are responsible for ensuring a private, secure environment during sessions; (c) you will not record sessions without the prior written consent of your provider, in compliance with New York Penal Law § 250.05 (eavesdropping); (d) the Practice uses HIPAA-compliant telehealth platforms but cannot guarantee absolute security of electronic transmissions; and (e) if a telehealth session is interrupted and cannot be resumed, the provider will attempt to contact you by phone to complete the session or reschedule.
11. Geographic Limitation — New York State Only
Holistic Minds Psychiatry is licensed to provide psychiatric services only to individuals physically located in New York State at the time of service. By scheduling and attending an appointment, you represent and warrant that you are physically present in New York State. The Practice shall not be liable for any consequences arising from a Client's misrepresentation of their location. Clients who relocate outside of New York State must notify the Practice immediately and understand that services may be discontinued.

The content on this website, including all text, screening tools, articles, and resources, is provided for general informational and educational purposes only. It does not constitute medical advice, diagnosis, or treatment. Online screening tools (e.g., GAD-7, PHQ-9, ASRS) are self-report instruments intended to assist in identifying potential symptoms and are not diagnostic. 14. Indemnification
To the fullest extent permitted by New York law, you agree to indemnify, defend, and hold harmless Holistic Minds Psychiatry, its owners, providers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of this website or our services; (b) your violation of these Terms and Conditions; (c) your provision of false or misleading information; (d) your failure to seek emergency services when clinically indicated; or (e) your violation of any applicable law or the rights of any third party.
15. Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the services provided by the Practice shall be subject to the exclusive jurisdiction of the state and federal courts located in Nassau County, New York. Before initiating any legal proceeding, you agree to provide the Practice with written notice of the dispute and a 30-day opportunity to resolve it informally.
16. Severability and Waiver
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable under applicable New York law, the remaining provisions shall continue in full force and effect. The Practice's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
17. Modifications to Terms
Holistic Minds Psychiatry reserves the right to modify these Terms and Conditions at any time. Changes will be effective upon posting to this website with an updated "Last Updated" date. Your continued use of this website or services after any modification constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
